1. Agreement to Sell
- The Seller agrees to sell, and the Buyer agrees to purchase, the electronic device(s) listed and described during the quote process, subject to the terms of this Agreement.
- The Seller guarantees that they are the legal owner of the device(s) and that the device(s) is/are free of any liens, claims, or encumbrances.
- The Seller guarantees that the device(s) has/have not been reported as lost or stolen and are not part of any insurance claim.
2. Device Condition
- The Seller is required to accurately describe the condition of the device(s) during the quote process.
- Device conditions are classified as follows:
- New Condition: The device is unopened, unused, and still in its original packaging.
- Good Condition: The device is fully functional, with minor wear and tear.
- Poor Condition: The device is functional but has visible signs of damage or wear.
- Broken Condition: The device is significantly damaged, but still intact.
- The Buyer reserves the right to evaluate and verify the condition of the device(s) upon receipt. If the condition does not match what was described, the Buyer will issue a revised offer based on the actual condition.
3. Inspection and Acceptance
- Upon receipt of the device(s), the Buyer will conduct a thorough inspection, including functionality testing and verification of the physical condition.
- If the device(s) meet the conditions described by the Seller, the Buyer will accept the sale and process payment.
- If the condition of the device(s) differs from the original description, the Buyer will notify the Seller with a revised offer.
- The Seller has the option to accept the revised offer or request that the device(s) be returned to them at no cost.
4. Payment Terms
- The Buyer agrees to pay the Seller the amount agreed upon, based on the device’s condition and specifications.
- Payment will be made within 24 hours after the Buyer's acceptance of the device(s) following inspection.
- Payment will be issued via the Seller’s chosen payment method, including bank transfer, PayPal, or cheque.
- If the Seller does not respond to the revised offer within 7 days, the revised offer will be considered accepted, and payment will be processed.
5. Shipping and Risk of Loss
- The Buyer will provide a prepaid Royal Mail shipping label for the Seller to send the device(s).
- The Seller agrees to package the device(s) securely to prevent damage during transit.
- The Seller assumes all risk of loss or damage to the device(s) until the Buyer takes possession of the device(s).
- The Buyer is not responsible for any damages to the device(s) that occur during shipping due to improper packaging by the Seller.
- Devices must be received by the Buyer within 14 days of receiving the quote. If the device is not received within this period, the quoted price may be updated based on current market conditions.
6. Ownership Transfer
- Upon the Buyer’s acceptance of the device(s) and completion of payment, ownership of the device(s) transfers from the Seller to the Buyer.
- The Seller agrees that once payment is issued, the transaction is final, and the Seller forfeits any claim to the device(s).
7. Device Warranties
- The Seller warrants that the device(s) being sold is/are the original, authentic device(s) and contain no counterfeit or third-party parts.
- The Seller warrants that the device(s) is/are free from any software or hardware issues not disclosed during the sale.
- The Seller confirms that all personal data has been removed from the device(s) and any linked accounts (such as Apple iCloud or Google) have been deactivated.
- The Seller guarantees that the device(s) is/are not blacklisted or reported stolen.
8. Return of Device
- If the Seller declines the revised offer, the Buyer will return the device(s) to the Seller free of charge via Royal Mail.
- The Seller agrees to notify the Buyer if they would like to request signature confirmation or insurance on the returned shipment. Additional fees for these services may apply.
9. Governing Law
- This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
- Any disputes arising from this Agreement shall be resolved through arbitration or in the small claims court in the jurisdiction of the Buyer’s principal place of business in the United Kingdom.
10. Entire Agreement
- This Agreement constitutes the entire understanding between the Parties and supersedes any prior agreements or understandings, whether written or oral, regarding the sale of the device(s).
By submitting your device(s) for sale to Sell Any Device, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.
